Golf Course & Residential Permitting

Burns & McDonnell provided after-the-fact environmental permitting services for a golf course and residential development community because of a Cease & Desist Order issued for disturbing a mile of stream channel during construction of two stormwater retention basins and relocating other stream channels without a Section 404 Permit.

In order for the development to proceed, Burns & McDonnell had to complete several tasks to reassure the U.S. Army Corps of Engineers (Corps) that the project was "on track" to submit an application packet for an after the fact Section 404 Individual Permit.

Burns & McDonnell provided constant communication with regulatory agencies (U.S. Environmental Protection Agency, U.S. Fish & Wildlife Service, Missouri Department of Natural Resources, Missouri Department of Conservation, and the Missouri State Historic Preservation Office). We also prepared a wetland delineation report and a mitigation plan.

Two utility line projects also were scheduled for immediate construction that required a Section 404 permit for crossing two streams. The projects consisted of a 24-inch sewer line and a one-mile 161-kV underground transmission line. In order to keep them on schedule Burns & McDonnell negotiated with the Corps to issue two separate Nationwide Permits. This is not a typical practice of the Corps, especially when there has been a Cease & Desist Order issued on a project site. The sewer line project was completed on time and within budget.
