Boiler MACT Compliance
On Dec. 2, 2011, the Environmental Protection Agency (EPA) issued proposed amendments to the National Emission Standard for Hazardous Air Pollutants (NESHAP) for Industrial, Commercial and Institutional Boilers and Process Heaters, commonly referred to as the Industrial Boiler MACT Rule. The proposed amendments are effectively a re-proposal of the rule that was finalized in March 2011 but stayed by the EPA in May 2011. The re-proposed rule has significant changes from the March 2011 stayed rule.

The Time to Act Is Now
The EPA expects to finalize the rule by late spring 2012, and boilers will be required to comply three years later — approximately in late spring or early summer 2015. Each compliance situation is unique. Facilities should plan now to meet the anticipated 2015 compliance date. In general, compliance planning (testing and preliminary studies) can take six to 12 months, and air pollution control retrofits or new boiler installations can take from 12 to 30 months.
